This page explains the terms by which you may use our online and/or mobile services, website, and software provided on or in connection with the service (collectively the “Service”). By accessing or using the Service, you agree to be bound by these Terms and Conditions (“Terms”) and to the collection and use of your information as set forth in the Privacy Policy below. If you do not agree to, or cannot comply with the Terms including the Privacy Policy, you are prohibited from using, navigating, or accessing this Service. These Terms apply to all visitors, users, members, contributors, and others who access the Service (“Users”).  The terms “you” or “your” as used in this Agreement each refers to you as the user of the Website.

Our Service in a Snapshot

AFM provides pilot training industry suppliers a platform to get brand exposure with international pilot training industry stakeholders; provides organisations and individuals with access to market intelligence consisting of either the general pilot training industry news or database of approved training organizations or both; and provides industry stakeholders with specialized Digital Marketing, Mergers & Acquisitions, Market, and Management advisory services.

Copyright Notice

All content in the Service including those that have been included with prior consent and/or attribution of other copyright owners belongs to AFM. 

Unless otherwise authorized, no part of this Service or its content hereof may be transmitted, stored in any other website or other forms of electronic retrieval system, or those similar in nature.

Reproduction in any form, printing, or downloading a part or all of the content is forbidden except under the following circumstance.

To copy for personal use: You may print copies of any item in hard copy provided that you do not edit, alter, amend, or delete any part of it, or combine it with other material. Use of Client’s/Subscriber’s Logo

The client (subscriber) grants AFM permission to use any name or logo used by the client in any marketing materials of AFM which includes, among others, presentations, brochures, social media graphics, and posters.

While we endeavour to ensure that the information on the Service is correct, we do not warrant the accuracy and completeness of the material on the Service. The information provided in this Service is for pilot training and aviation industry stakeholders to be seen as general information only. Some information in the Service is based on our own analyses and research of a particular aspect of the industry and may consist of personal views or a combination of both facts and opinions. Hence, full credence on the information provided is not tantamount to professional or legal advice. We may make changes to the contents on the Service at any time and without notice. The material on the Service may be out of date and we make no commitment to update such material. We do not claim that all content in the Service is error-free.

You agree to defend, indemnify, and hold harmless AFM and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from (i) your use of and access to the Service, including any data or content transmitted or received by you; (ii) your violation of any third-party right, including without limitation any right of privacy, publicity, or Intellectual Property Rights; or (iii) your violation of any applicable law, rule, or regulation.

No Warranty

The service is provided on an “as is” and “as available” basis. Use of the Service is at your own risk. To the maximum extent permitted by applicable law, the service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Without limiting the foregoing, AFM, its subsidiaries, and its licensors do not warrant that the content, is accurate, reliable, or correct; that the service will meet your requirements; that the service will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected; or that the service is free of viruses or other harmful components. Any content downloaded or otherwise obtained through the use of the service is downloaded at your own risk and you will be solely responsible for any damage to your computer system or mobile device or loss of data that results from such download or your use of the service.

AFM does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through afm.aero or any hyperlinked website or service, and AFM will not be a party to or in any way monitor any transaction between you and third-party providers of products or services.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AFM, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, that result from the use of, or inability to use, the Service. Under no circumstances will AFM be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or the information contained therein.

To the maximum extent permitted by applicable law, while we use reasonable efforts to include accurate and up to date information, AFM assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our Service; (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein; (iv) any interruption or cessation of transmission to or from the service; (v) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party; (vi) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service; and/or (vii) user content or the defamatory, offensive, or illegal conduct of any third party. The Service is controlled and operated from one of its global office locations. AFM makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable local laws and regulations, including but not limited to export and import regulations.

Information you provide us directly

We may ask for certain information such as Name, Email Address, Country, and Phone Number when you use one of the contact forms or Chatbot or if you correspond with us. Further, we may ask you other pertinent details we see fit and appropriate for us to be able to provide the service to you and tailor-fit it to your needs. We may also retain any messages you send through our platform. We use this information to operate, maintain, and provide you the service we offer. We may also use this information to correspond with you and to address any issues you raise about our Service. Should you consider that the information you provided is too personal, you can always inform us to retract the information from our database. 

Information we collect from you automatically

We may directly collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Service. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving the Service. We collect and use this analytics information in aggregate form such that it cannot reasonably be manipulated to identify any particular individual user.

Cookies information

Log file information

Log file information is automatically reported by your browser or mobile device each time you access the Service. When you use our Service, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, the number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information.

Clear gifs/web beacons information

When you use the Service, we may employ clear GIFs (also known as web beacons) which are used to anonymously track the online usage patterns of our Users. In addition, we may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. This information allows for more accurate reporting and improvement of the Service.

Device identifiers

When you access the Service by or through a mobile device (including but not limited to smartphones or tablets), we may access, collect, monitor and/or remotely store one or more “device identifiers,” such as a universally unique identifier (“UUID”). Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. Location data

When you access the Service by or through a mobile device, we may access, collect, monitor and/or remotely store “location data”, which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device. Location data may convey to us information about how you browse and use the Service. Some features of the Service, particularly location-based services, may not function properly if the use or availability of location data is impaired or disabled.

How we use your information

We use the information we collect about you for the following purposes:

  • Providing you with the Service: We use the information that you provide us to provide the Service to you. This includes operating and maintaining the Service, providing you a platform to get brand exposure with international pilot training industry stakeholders, access to market intelligence consisting of news & database, and specialized Digital Marketing, Mergers & Acquisitions, Market and Management advisory services.
  • For data analytics: We use information about you to help us improve the AFM Service and our users’ experience, including by monitoring aggregate metrics such as the total number of visitors, traffic, and demographic patterns.
  • Customizing the Service for you: We use the information you provide us and information about you to make sure that your use of the Service is customized to your needs. 
  • To communicate with you about the Service: We use your contact information to get in touch with you and to send communications about critical elements of the Service. For example, we may send you emails about technical issues, security alerts, or administrative matters.
  • To promote and drive engagement with the AFM Service: We use your contact information to get in touch with you about offers relating to the Service that we think you would be interested in. We also use the information we collect about you to make sure that you get the most relevant offers and promotions based on your use of the Service, and your preferences. You can opt out of getting these communications.
  • For security measures: We use information about you to monitor activity that we think is suspicious or potentially fraudulent, and to identify violations of this Privacy Policy or our Terms of Service.

Legal bases for processing information under the GDPR (for users in the EEA)

For AFM users in the European Economic Area (EEA), AFM processes your information in accordance with European laws and regulations such as the General Data Protection Regulation (GDPR). The GDPR governs how AFM may process your information and the rights that EEA users have in relation to it. This means that AFM will collect and use your information only where:

  • We need it to provide you the Service and fulfill our obligations to you under our Terms of Service.

Sharing your information

We may share your information with third-party service providers for the purpose of providing the Service to you and to facilitate AFM’s interests. By filling our contact form or chatbot you are giving AFM consent to share or sell your information to third parties outside AFM. Some of the third parties that AFM may share your personal information which include providers who assist AFM with functions such as:

  • Analytics
  • Email services
  • Billing
  • Flight Schools
  • Pilot Simulator Training Centers
  • Suppliers
  • Airlines
  • Companies operating in the Pilot Training Industry

AFM may also share your information with third parties in certain circumstances, such as where:

  • we are required to do so as a result of a court order, subpoena, or other legal requirements;
  • we believe that it is necessary to protect you or AFM, such as where we consider that there is a need to investigate potentially fraudulent or criminal activity; or

Ads on AFM

We may share certain information such as your location, browser and cookie data, and other data relating to your use of our Service with our business partners to deliver personalized advertisements (“ads”) that may be of interest to you. AFM may allow third-party ad servers or ad networks to serve personalized advertisements. These third-party ad servers or ad networks use technology to send, directly to your browser or mobile device, these personalized ads and ad links, and will automatically receive your IP address when they do so. They may also use other technologies (such as cookies, JavaScript, device identifiers, location data, and clear gifs, see above) to compile information about your browser’s or device’s visits and usage patterns on the Service, and to measure the effectiveness of their ads and to personalize the advertising content. AFM does not sell, rent, or share the information we collect directly from you or about you from third parties with these third-party ad servers or ad networks for such parties’ own marketing purposes.

Please note that an advertiser may ask AFM to show an ad to a certain audience of Users (e.g., based on demographics or other interests). In that situation, AFM determines the target audience and AFM serves the advertising to that audience and only provides anonymous aggregated data to the advertiser. If you respond to such an ad, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach.

The AFM Privacy Policy does not apply to, and we cannot control the activities of, third-party advertisers. Please consult the respective privacy policies of such advertisers or contact such advertisers for more information.

How we transfer, store and protect your data

Your information collected through the Service may be stored and processed in a country or countries in which AFM or its subsidiaries, affiliates, or service providers maintain facilities. AFM may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world.
